Body Academy Membership Terms and Conditions
Thank you for choosing Body Academy, operated by Rebekah Riches. These Terms and Conditions govern your participation in the Body Academy Membership. By clicking “accept”, “buy now”, “purchase”, or any other phrase on the purchase button, entering your payment information, or otherwise enrolling, you agree to the Terms and Conditions set out below.
These Terms and Conditions should be read in conjunction with the information provided on the website at www.joinbodyacademy.com (the Website), including the relevant sales page and checkout page.
1. Parties
1.1 You are the Member.
1.2 Body Academy is operated by BR Body Academy (ABN: 85218804551) of 302 South Terrace, South Fremantle, Perth, Western Australia, trading as Body Academy and Rebekah Riches (we, us, our).
2. Membership Access and Inclusions
2.1 The Body Academy Membership (Membership) is an online, subscription-based membership for massage therapists and related practitioners.
2.2 As a Member, you will receive access to:
Monthly mentorship calls with pre-submitted questions;
The content library (Massage Mastery, Elevated Client Experience, Fully Booked Business, Therapist Vitality Vault);
Live masterclasses delivered while you are a Member;
Rolling access to past masterclass recordings;
Access to a peer community space.
2.3 The Membership does not include personalised coaching or feedback outside of the Monthly Mentorship Calls. Such support is only available under a separate Inner Circle Coaching Program.
3. Fees and Payment
3.1 Membership is offered on a monthly subscription basis at $99 AUD per month (unless otherwise stated).
3.2 Payments are processed automatically via the Website and will continue unless you cancel in accordance with clause 4.
3.3 If a payment fails, we will attempt to reprocess. If payment remains outstanding for more than 7 days, your Membership may be suspended or terminated until payment is received.
3.4 Prices are listed in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.
3.5 We may change the Membership fee from time to time. If this occurs, we will provide at least 14 days’ notice. Any changes will apply from your next billing period.
4. Cancellations and Refunds
4.1 You may cancel your Membership at any time via your account or by emailing support@joinbodyacademy.com.
4.2 Cancellation will take effect at the end of your current billing period. You will retain access until that date.
4.3 Once your Membership ends, all access to the content library, masterclasses, recordings, and the community space will cease.
4.4 All fees paid are strictly non-refundable. No refunds, credits, or pro-rata adjustments will be provided for unused time, change of mind, failure to use the Membership, or dissatisfaction with the content.
4.5 If you have purchased an annual plan, you are committed to the full term of the plan. No refunds will be issued if you choose to cancel before the end of the term. In extenuating circumstances, you may submit a written request for early termination. Any refund or credit issued in such cases will be at our sole discretion and may be subject to a deduction for the first month of access. The granting of a refund or credit in one instance does not oblige us to do so in the future.
4.6 If any payment is overdue or declined, we reserve the right to suspend or terminate your Membership until payment is received. You remain responsible for any outstanding amounts, including any fees incurred by us in recovering payment.
4.7 Nothing in these Terms affects your rights under the Australian Consumer Law.
5. Intellectual Property
5.1 All content provided as part of the Membership, including but not limited to videos, audio recordings, written materials, workbooks, slides, templates, graphics, digital downloads, and any other resources, remains our sole and exclusive intellectual property.
5.2 You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the content solely for your personal, non-commercial use while you are an active Member. This licence automatically terminates when your Membership ends.
5.3 You must not copy, reproduce, record, modify, adapt, create derivative works from, publish, share, sell, sublicense, distribute, or otherwise exploit any Membership content in any form, whether in whole or in part, without our prior written consent.
5.4 Any unauthorised use of the content constitutes a breach of these Terms, may infringe our copyright and intellectual property rights, and may result in immediate termination of your Membership without refund, and/or legal action.
6. Community Guidelines
6.1 You agree to participate in the Membership community respectfully and professionally.
6.2 You must not harass, abuse, defame, discriminate, or otherwise engage in inappropriate conduct.
6.3 You may not advertise or promote your services, products, or events without our written approval.
6.4 We reserve the right to remove any content you post or to terminate your Membership without refund if you breach these guidelines.
7. Disclaimers
7.1 The Membership provides educational content only. It is not medical advice, health advice, legal advice, financial advice, or business advice, and should not be relied upon as such.
7.2 You are solely responsible for how you choose to apply the information in your own professional practice. You acknowledge that your success depends on many factors outside our control, including but not limited to your level of skill, effort, experience, client base, and market conditions.
7.3 We make no guarantees, representations, or warranties regarding specific outcomes or results from your participation in the Membership. This includes, but is not limited to, client outcomes, client retention, increased income, career progression, or business growth.
7.4 To the fullest extent permitted by law, we disclaim all liability for any loss, damage, or injury (including indirect, incidental, special, or consequential damages) arising out of your reliance on or use of the Membership content.
7.5 We are not responsible for any interruptions, delays, errors, or failures caused by third-party platforms (including Circle, Zoom, or Stripe), software, or your internet connection, nor are we liable for any loss of access caused by such events
8. Limitation of Liability
To the fullest extent permitted by law, our liability for any claim in connection with your Membership is limited to either:
(a) resupplying the Membership; or
(b) at our discretion, refunding the Membership fee paid for the most recent billing period.
We are not liable for any indirect, incidental, special, or consequential loss or damages arising from your use of the Membership.
9. Confidentiality and Privacy
9.1 Any personal information you provide will be handled in accordance with our Privacy Policy, available at [insert link].
9.2 We will not disclose your confidential information except as required by law or with your consent.
10. Force Majeure
We are not liable for delays or failure to perform our obligations due to events beyond our reasonable control, including natural disasters, illness, government restrictions, or third-party platform failures.
11. Marketing
By joining the Membership, you agree that testimonials or feedback you provide may be used for marketing purposes.
12. Mailing List
By enrolling in the Membership, you will be added to our mailing list. You may unsubscribe at any time by following the link in our emails.
13. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter in good faith before commencing legal action. Mediation will take place in Western Australia if required.
14. Governing Law
These Terms and Conditions are governed by the laws of Western Australia. If you access the Membership from outside Australia, you are responsible for compliance with local laws.
15. Entire Agreement
These Terms and Conditions, together with the information on the Website, constitute the entire agreement between you and Body Academy.
